Terms of Service Agreement

This Terms of Service Agreement ("Agreement") is a legal agreement between you ("User") and Sowiks Team ("Company") governing the use of “Sowiks”, a desktop application developed by Company for use on macOS.

By using Sowiks, User agrees to be bound by this Agreement. If User does not agree to be bound by this Agreement, User should not use Sowiks.

1. Use of Sowiks

User is granted a non-exclusive, non-transferable, limited license to use Sowiks. All features are available for seven (7) days, counted from the first capture User completes, without an account or payment. After that period, window capture and the built-in editor remain available at no cost and for as long as User wants them; the remaining capture modes, text recognition, cloud storage, share links and screen recording require a purchased license.

If User decides to use Sowiks for commercial purposes, User must purchase a license from Company for such use.

If User decides to purchase a license, User may be granted access to additional features and will receive priority technical support.

2. License Scope, Devices and Updates

A purchased license entitles one (1) User to use the paid features of Sowiks on one (1) Mac. All purchases are processed by the Apple App Store and are associated with User's Apple Account. Company does not control how Apple makes purchased content available across devices signed in to the same Apple Account, and any such availability does not widen the license granted under this Agreement.

A purchased license includes the updates Company releases during the twelve (12) months following the date of purchase. After that period, Company is under no obligation to provide further updates. Company may offer to renew the update period at the price published at the time of renewal; renewal is optional.

The end of the update period does not disable Sowiks, revoke the license or remove any feature already delivered. User may continue to use the last version received for as long as User wishes, with no renewal, subscription or account check required.

Company may from time to time provide patches, bug fixes, updates, upgrades and other modifications, which may add, alter or remove features. Company is under no obligation to provide any of these, to maintain any particular feature, or to keep Sowiks compatible with future versions of macOS or with third-party services on which a feature depends.

Company may change its prices and the terms of this Agreement. Such changes apply to purchases completed on or after the date the change is published, and do not shorten an update period already granted for a purchase completed before that date.

3. Refund Policy

All Sowiks purchases are currently made through the Apple App Store. Refunds are handled entirely by Apple, under Apple's own policy. Once Apple approves a refund, Company is notified automatically and revokes the associated license.

4. Image Uploading Functionality

The image uploading feature is intended for sharing static screen-size screenshots with private parties.

Uploaded images become public and should be treated as such. Anyone who finds, guesses, or otherwise obtains an image URL can see the uploaded image.

The image uploading feature should not be used for the following purposes:

  • Hosting static images embedded elsewhere.
  • Sharing images that are not screenshots.
  • Sharing private or sensitive information.

You agree not to upload and/or share images containing the following content:

  • Private or sensitive information.
  • Images that are illegal or violate any laws.
  • Pornography, adult, mature, or obscene content.
  • Images protected by intellectual property laws, unless you own or control the rights.
  • Violent images of any kind.
  • Images promoting hatred of any kind.
  • Images depicting or otherwise promoting drugs.
  • Content that promotes illegal activity.
  • Content that can be potentially malicious.

Uploading such images will be considered abuse, and will result in revoking the uploading privileges.

Company will use its discretion to determine if any given image falls under any of the categories above.

Every uploaded image will be moderated, both automatically and manually. If the image is deemed inappropriate, it may be removed without notice.

Company provides no guarantee regarding image storage time and availability.

Images uploaded during the seven-day trial period are removed if no license is purchased, on the following schedule.

Three (3) days after the trial period ends, uploaded images stop being shown in the account and share links to them report that the file is no longer available. The images are not deleted at this point: purchasing a license restores all of them.

Fourteen (14) days after that, the image data is permanently erased. Purchasing a license after this point does not bring erased images back, and Company keeps no copy from which they could be recovered.

5. Intellectual Property Rights

All intellectual property rights in Sowiks, including but not limited to patents, copyrights, trademarks, and trade secrets, are owned by Company or its licensors. User acknowledges and agrees that User has no rights or interests in Sowiks except as expressly granted in this Agreement.

User may not copy, modify, distribute, or reverse engineer Sowiks or any part thereof, except as expressly authorized by Company in writing.

6. Disclaimer of Warranties

Sowiks is provided "AS IS" and without warranty of any kind. Company makes no representations or warranties, express or implied, regarding the quality, accuracy, reliability, completeness, suitability, availability, or performance of Sowiks or any part thereof.

7. Limitation of Liability

In no event shall Company be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use Sowiks, even if Company has been advised of the possibility of such damages.

8. Indemnification

User agrees to indemnify and hold harmless Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with User's use of Sowiks.

9. Miscellaneous

This Agreement constitutes the entire agreement between User and Company and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between User and Company.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
